实务案例分析视角下在校生实习、兼职的劳动维权问题研究
Research on Labor Rights Protection of Internship and Part-Time Students from the Perspective of Practical Case Analysis

近十年来，高校学生在校期间从事实习、兼职的人数不断上升，随之而产生的高校学生劳动维权事件逐渐变成了热点。笔者以与在校学生劳动维权相关，尤其是与《关于贯彻执行〈中华人民共和国劳动法〉若干问题的意见》第十二条相关的179份相关判决为切入点，从实务角度对在校生实习、兼职期间的劳动维权问题进行剖析，并将从立法论视角对有关法律、法规的适用与废止提出见解。
In the past ten years, the number of college students engaged in internship and part-time jobs has been increasing, and the resulting labor rights protection incidents of college students have gradually become a hot spot. Taking judgments related to labor rights protection of school students, especially 179 judgments related to Article 12 of the Opinions on Several Issues Concerning the Implementation of the Labor Law of the People’s Republic of China as the breakthrough point, the author not only analyzes the labor rights protection issues of students during internships and part-time jobs from the perspective of the practice, but also puts forward opinions on the application and abolition of relevant laws and regulations from the legislation.
