网络著作权犯罪的问题与完善——基于刑法修正案(十一)视角
Problems and Perfection of Network Copyright Crime—From the Perspective of Criminal Law Amendment (XI)

与传统的侵犯著作权相比，网络著作权犯罪具有成本低、方式新颖、隐匿性强等特点，这就需要对现行侵犯著作权罪进行相关调整。《刑法修正案(十一)》20条对侵犯著作权进行了相应的修改，但仍然存在网络服务提供者规定较为模糊、仅以营利作为主观目的、入罪标准较为模糊等缺陷。对此，应当通过明确网络服务提供者作为犯罪主体、扩大主观方面到非营利目的等方式对其进行完善。
Compared with the traditional infringement of copyright, the network copyright crime has the characteristics of low cost, novel ways, and strong concealment, which requires relevant adjust-ments to the current infringement of copyright crime. Article 20 of the Criminal Law Amendment (XI) has made corresponding amendments to copyright infringement, but there are still some defects, such as vague provisions on network service providers, only taking profit as the subjective purpose, and vague criteria for criminalization. In this regard, we should improve the network service provider by making it clear that the network service provider is the subject of crime and expanding the subjective aspect to non-profit purposes.
