论中国劳动教育宪治属性的三重逻辑

Abstract:
劳动教育在育人中具有独特且无可替代的重要作用,需要纳入宪治轨道进行治理。对于劳动教育的宪治属性可以从理论、现实和路径三个维度进行解释:劳动及劳动关系对我国社会主义根本制度和人民民主专政国体的决定性作用,从理论层面内在地规定了劳动教育的宪治属性;劳动及劳动教育的宪法条文规定,从现实层面外在地印证了劳动教育宪治的客观需要;而遵循规范预设的宪治闭环路径以法治手段推动劳动教育制度化体系化现代化发展,则彰显了劳动教育宪治的未来方向。
Labor Education plays a unique and irreplaceable role in educating people, which needs to be governed by the constitution. The constitutional attribute of Labor Education can be explained from three dimensions: theory, reality and path: The decisive role of labor and labor relations in China’s fundamental socialist system and the national system of people’s democratic dictatorship inherently stipulates the constitutional attribute of labor and labor education from the theoretical level; The constitutional provisions of labor and labor education externally confirm the constitutional attribute of labor and labor education from the practical level; Following the constitutional closed-loop path preset by norms and promoting the institutionalization, systematization and modernization of labor education by means of rule of law is an inevitable requirement to highlight the constitutional attribute of labor education.
