“三权分置”视角下农村宅基地使用权流转研究
A Study on the Transfer of the Right to Use Rural Homestead from the Perspective of “Three Rights Division”

2018年中央一号文件首次提出探索农村宅基地所有权、资格权、使用权“三权分置”改革，寻求解决农村宅基地问题的路径。宅基地“三权分置”改革作为农村土地制度改革的重中之重，是解决“三农问题”的有力推手，是增加农民可持续财产性收入的重要突破口，为实现乡村振兴以及推进高质量发展提供了新的发展方向。基于此，本文以贵州省内部分试点地区的改革措施和改革效果为例，分析并总结各地在进行宅基地改革中出现的问题以及经验启示，以期可以对贵州省正在进行宅基地改革的试点地区提供有益借鉴。
In 2018, the No. 1 Document of the Central Committee put forward for the first time to explore the reform of the “separation of ownership, qualification right and use right” of rural homestead, and seek the path to solve the problem of rural homestead. As the top priority of rural land system reform, the reform of “three rights separation” of homestead is a powerful driver to solve the “three rural issues”, an important breakthrough to increase farmers’ sustainable property income, and provides a new direction for rural revitalization and high-quality development. Based on this, this paper takes the reform measures and reform effects of some pilot areas in Guizhou Province as an example to analyze and summarize the problems and experience enlightenment in the homestead reform in various regions, hoping to provide useful lessons for the pilot areas in Guizhou Province that are carrying out the homestead reform.
