虚拟财产交易民事纠纷浅见——以自媒体账号为例
Transaction Disputes in Virtual Property—Taking Self-Media Accounts as an Example

互联网浪潮下自媒体平台越加活跃，以个人账户为代表的虚拟资产快速发展，相应的也引出一系列的问题。自媒体账号能否交易、交易过程中面临的困难以及自媒体平台与个人账号的关系如何处理，在这些问题的解决上相关法律法规还有待完善。本文采用文献分析法和实证研究法从虚拟财产的理论研究和自媒体账号交易案例入手，侧重分析权威性案例中自媒体账号交易出现的纠纷，表明各国政府对自媒体账号交易的相关法律规则的看法、理清虚拟财产和自媒体账号界定，并对自媒体账号交易中存在的部分法律问题提出浅显的建议，为司法实践中探索自媒体账号交易提供思路。
Self-media platforms are becoming more and more active. The growth of the Internet has facilitated the development of virtual assets, leading to a series of problems. Whether self-media accounts can be traded, the difficulties faced in the process of trading and how to deal with the relationship between self-media platforms and personal accounts, the relevant laws need to be improved in the resolution of these issues. This article adopts mainly literature analysis method and empirical research method, analyzing disputes arising from the trading of self-media accounts in authoritative cases. It shows the views of governments on the legal rules related to the trading of self-media accounts, clarifies the definition and characteristics of virtual property, and meanwhile, provides superficial suggestions to some of the legal issues in trading of self-published accounts. Finally, provide ideas for exploring the trading of self-media accounts in judicial practice.
