老龄化背景下精神赡养的法治化路径

在我国人口老龄化背景下，老年人法律层面的权益保障逐渐走进人们的视野，老龄化社会对赡养老人提出了更高要求。精神赡养是现代社会提出的与物质赡养相对应的概念，是在老年人物质生活基本得到保障以后应运而生的精神需求。我国精神赡养制度发展存在人口老龄化加剧、社会道德观念复杂、家庭结构变化等现实背景，精神赡养入法必要、正当且可行。我国精神赡养在法律概念、法律制度、司法判决以及执行等方面有待完善，需确定精神赡养概念的核心要素，国家与地方立法共同服务精神赡养，建立调解前置、案例指导与圆桌审判制度多元化纠纷化解机制，从各方面完善精神赡养法律制度，用法治为和谐社会保驾护航。
Under the background of my country’s aging population, the legal protection of the rights and in-terests of the elderly has gradually entered people’s field of vision, and the aging society has put forward higher requirements for supporting the elderly. Spiritual support is a concept corresponding to material support put forward in modern society, and it is a spiritual need that emerges as the times require after the material life of the elderly is basically guaranteed. The development of my country’s spiritual support system is based on the realistic background of the aging population, complex social and moral concepts, and changes in family structure. My country’s spiritual support needs to be improved in terms of legal concept, legal system, judicial judgment and implementation, etc. It is necessary to determine the core elements of the concept of spiritual support, national and local legislation to jointly serve spiritual support, and establish a diversified system of pre-mediation, case guidance and round-table trial. The dispute resolution mechanism improves the legal system of spiritual support from all aspects, and escorts a harmonious society with the rule of law.
