当前我国庭审直播存在的问题及其完善——基于对中国庭审公开网案件的实证研究
Current Problems and Improvement of Live Trial in China—Based on the Empirical Study of China Open Court Cases

随着我国司法改革的开展，互联网法院的建设，庭审直播的建设速度随之增强，庭审直播在促进司法公开、提高司法公信力方面发挥的作用也愈发重要。我国的庭审直播在国家政策支持、顺应司法改革的趋势、科学技术的创新和应用、法律实效的体现及公众法治观念的提高等多重因素影响下迅速发展。庭审直播方式也不再局限于电视、图文报道等方式，新兴技术的发展和应用丰富了庭审直播方式，增加了微博庭审直播、远程庭审直播等新兴直播类型。通过研究中国庭审公开网和微博的庭审直播案件过程，发现存在庭审直播观看的准入条件缺乏、庭审直播案件观感体验差、庭审直播中的个人信息保护、舆论等方面等现实且紧迫的问题，对此应当完善庭审直播网站准入条件、提高案件直播案件质量、完善个人信息保护措施、监测社交平台后台数据以及合理引导舆论导向等措施，以期庭审直播发展更加完善。
With the development of China’s judicial reform and the construction of Internet courts, the construction speed of live trials is increasing. Live trial plays an increasingly important role in promoting judicial openness and improving judicial credibility. Under the influence of national policy support, the trend of judicial reform, the innovation and application of science and technology, the embodiment of legal effectiveness and the improvement of the public’s concept of the rule of law, the live trial in China has developed rapidly. The ways of the live trial are no longer limited to TV and graphic reports. The development and application of emerging technologies enrich the ways of live trials, and new types of live trials emerge, such as Weibo live trial and remote live trial. By studying the process of live trial cases on China open Court and Weibo, it is found that there are practical and urgent problems such as lack of access conditions for watching live trials, poor perception and experience of live trial cases, personal information protection, public opinion and other aspects in the live trial. In this regard, it is necessary to improve the access conditions of trial live broadcast websites, improve the quality of case live broadcast, improve personal information protection measures, monitor background data of social platforms and reasonably guide the direction of public opinion, so as to improve the development of trial live broadcast.
