Abstract:

在数字经济时代下,个人信息成为一种重要的资源,与企业的发展和经济的发展息息相关。我国法律对个人信息保护做出了规定,实践中移动应用也通过隐私政策声明用户个人信息保护的相关事项,但根据易观移动应用榜单、Talking Data移动观象台应用排行和人们日常熟知的移动应用,选取11类21个移动应用隐私政策文本进行分析,其中仍存在诸如账号注销后个人信息处理模糊、应用停止运营后个人信息的处理不明、对未成年人个人信息保护主动性不足、应用运营商和用户之间的沟通不畅通等问题,可以通过建立独立的个人信息保护机构、完善个人信息处理机制、健全未成年人个人信息多方位保护机制、拓宽用户与运营商之间的对话路径,对个人信息进行更好的保护,促进互联网经济的良性发展。
In the era of digital economy, personal information has become an important resource, closely related to the development of enterprises and economic development. China’s laws have made provisions on the protection of personal information, and in practice, mobile applications also declare the relevant matters related to the protection of users’ personal information through privacy policies, but according to the list of analyzing mobile applications, the ranking of Talking Data mobile observatory applications and the mobile applications that people are familiar with every day, 21 mobile application privacy policy texts in 11 categories are selected for analysis, among which there are still such things as vague processing of personal information after account cancellation, and unclear processing of personal information after the application stops operation. For issues such as insufficient initiative in protecting minors’ personal information, poor communication between application operators and users, we may establish independent personal information protection bodies, improve mechanisms for handling personal information, improve mechanisms for the protection of minors’ personal information in various ways, and broaden the dialogue path between users and operators, so as to better protect personal information and promote the benign development of the Internet economy.
