我国刑事诉讼非法证据排除规则的缺陷与完善
An Analysis of the Defects of the Rules for the Exclusion of Illegal Evidence in China’s Criminal Proceedings and Suggestions for Improvement

刑事非法证据排除规则已被我国立法体系所适用，但是依然还不够完善，存在非法证据的范围不明确、适用程序不健全、审判机关地位受到影响、控辩双方证明要求不同等问题。究其主要原因，则是由于立法层面的不够完善，“排非规则”运行程序的不规范，以及司法实践中存在的操作方式不统一等原因。完善我国刑事非法证据排除规则，则需要明确其适用范围，优化司法机关排除非法证据的程序，引入“毒树之果”原则，并对一些例外规则予以补充。
The rules of criminal illegal evidence exclusion have been applied by China’s legislative system, but they are still not perfect, the scope of illegal evidence is not clear, the application procedures are not sound, the status of the trial authority is affected, and the prosecution and the defense have different requirements for proof. The main reason for this is the lack of perfection in legislation, the irregularity of the operation procedure of the “exclusion rule”, and the lack of uniformity in judicial practice. To improve China’s criminal illegal evidence exclusion rules, it is necessary to clarify the scope of its application, optimize the procedures of judicial organs to exclude illegal evidence, introduce the principle of “fruit of the poisonous tree”, and supplement some exceptions to the rules.
