Abstract:

2020年12月23日,教育部颁布了《中小学教育惩戒规则(试行)》,《规则》从2021年3月1日起正式实施,一年以来,教师在实际运用中仍有许多问题,根据《规则》界定来剖析教师实施教育惩戒偏差的表现以及教师视角下的原因,再从教师角度提出教师实施惩戒权应该掌握的“深度”、“限度”、“温度”、“宽度”四度原则,力求梳理出教育法制化道路下教师的“有所为有所不为”。
On December 23, 2020, the Ministry of Education promulgated the Primary and Secondary School Education Punishment Rules (Trial), and the Rules will be officially implemented from March 1, 2021. One year later, teachers still have many problems in practical application. According to the definition of the Rules, we will analyze the performance of teachers’ implementation of educational disciplinary deviation and the reasons from the perspective of teachers, and then put forward the “depth”, “limit”, “temperature” and “width” that teachers should master in implementing disciplinary rights from the perspective of teachers. The Four Degrees Principles strive to sort out what teachers do and do not do under the path of legalization of education.
