人身安全保护令的执行困境及完善对策

家庭暴力问题一直是社会的毒瘤，我国《反家庭暴力法》规定了人身保护令制度来解决这一问题。在实施过程中，对家庭暴力的制止和预防产生了一定的良好效果，但是人身保护令执行难的问题也日益凸显。人身保护令通过国家公权力的介入将家庭成员的内部纠纷转化为施暴方与法律的对立，禁止施暴方的一系列行为来达到保护受害者的目的。但我国现行法律法规对此方面仍有许多不足，如执行主体不合理，法律规定过于笼统，违反后的责任承担不明确等。目前司法实践中处理方式不一，难以产生威慑力。因此我们需要进一步明确执行主体和分工以及规定违反保护令后的责任承担等，更好地发挥该制度制止家庭暴力和保护受害人的作用。
Domestic violence is a long-standing social problem. China’s anti-domestic violence law clearly stipulates the system of “personal protection order”. In the process of implementation, the prevention and control of domestic violence have produced some good results. At the same time, the difficulty of the implementation of habeas corpus has become increasingly prominent. Through the intervention of state public power, habeas corpus transforms the internal disputes of family members into the opposition between the perpetrator and the state, and forbids a series of behaviors of the perpetrator to protect the victims. However, there are still many deficiencies in the current laws and regulations in China, such as the unreasonable subject of enforcement, too principled legal provi-sions, unclear responsibility after violation, etc. At present, there are different ways of handling judicial practice, which makes it difficult to produce deterrence. Therefore, we need to further clarify the implementation of the subject and division of labor, as well as the responsibility after violation of the protection order, etc., so as to better play the role of the system in stopping domestic violence and protecting victims.
