THE TYPES AND RULES OF TEKFIR ACCORDING TO ISLAMIC LAW

It is known that the religion is the first of five necessities that Islamic law aims to preserve them, but a group of people has appeared who facilitated the removal of Muslims from Islam without a certain evidence from Islamic law. The research gives the sections of disbelief (kufr) which is divided to an original disbelief and an accidental disbelief, it is divided also to disbelief in the heart, disbelief by saying and disbelief in action. The research has also establishes the rules of removal Muslims from Islam according to Islamic law. These rules are: Takfir is shar' i judgment, Judgment of apostasy issues by the judiciary, if there is suspicion or probability, there is no Takfir, Judgment according to the apparent and leave the conscience, and unidentified takfir does not require particular takfir
