THE METHOD MATTERS THAT IBN SüREYC AND SAYFAR？ OF EARLY-PER？OD SHAF？？ SCR？BES MADE AS CONTROVERSY AND THE REFLECT？ON OF TH？S CONTROVERSY ？N THE REL？G？OUS SECTS

Great F？qihs who made a big contribution in order to develop a systematized structure of the general f？qh science and- especially for Shafii f？qh thoughts -were educated in third and fourth centuries in the Hijri calendar. These important figures presented the f？qh heritages of their predecessors, which were in a dispersed situation, in an organized framework to their successors as evaluating these issues according to their own intellectual and interpretation. Abu’l-Abbas Ahmet b. Umar Ibn Süreyc el-Qad？ ve Muhammad b. Abdullah es-Sayraf？ is ones of these important figures. Contributions of these mentioned people for Shafii f？qh is an undeniable fact. Especially, their services on f？qh methodology are respectable. According to the speaker theologian methodology thoughts, there haven't been any methodological work coming nowadays, but Er-Risale of Iman Shafii, belongings these periods which are described as lost rings. As it was the first of its kind, we have to give due, however; it doesn't comprise all issues and rules of the methodology. For this reason, the methodology opinions of Ibn Süreyc and Sayrafi who lived in this period are so significant. In this regard, a methodological opinions causing controversy between both faqihs will scrutinize in this study: the provision of delaying declaration in the course of the address, the provision of performing with The General Term without investigating the dedicator, accepting notion of adjectives as an evidence, the provision of absolute acts of Prophet Muhammed (PBUH) on ummah, provision of comparison of certainty in lexical context and comparison of naskh. Basically, as each of these issues is able to study into a researching framework, it will be only evaluated these both faqihs' opinions on these mentioned issues comparatively
