THE COOPERATION PROCESS BETWEEN VIOLENT COMBATING AGAINST WOMEN AND THE APPLICABILITY OF LAW NO. 6284 IN TURKEY

Abstract:

State-sanctioned conventions, the work of non-governmental organizations and academic research have drawn attention to protective and preventive institutional frameworks and dynamics in the struggle with domestic violence against women. In Turkey, that same process was initiated by the women’s movement, which was followed by legal regulations and institutional frameworks. Issued in 1998 to fight domestic violence against women more effectively, Statute 4320 was revised in and reissued in 2012 as Statute 6284, “the Statute for the Protection of the Family and the Prevention of Violence Against Women” as part of the requirements of the Istanbul Convention. This statute mandated the establishment of a one-step system in the fight against domestic violence, namely, the “Centers for the Prevention and Tracking of Violence” (CPTV/??N?M). The statute projected working under the “single door” principle for the prevention and tracking of violence against women and its dissemination throughout Turkey. The institutions that are expected to cooperate with CPTVs in the prevention of domestic violence and the effective implementation of statute 6284 in Turkey are law-enforcement, non-governmental organizations for women, local administrations, bar associations, the legal establishment, and health organizations. This research focuses on how women, who are responsible for violence in the first place in the combating against violence in accordance with the requirements of Law No. 6284, deal with violence against women, how they fulfill the requirements of the law and how they operate cooperation processes between institutions. This research was undertaken in 6 of the cities (Antalya, Bursa, Gaziantep, Samsun, Denizli and Malatya) out of 14 where pilot CPTVs began offering their services in 2012. During fieldwork, intensive meetings were held with CPTV authorities, primary admissions and women’s shelters managers, security officials, healthcare organizations, family court judges, bar associations, local administrations, and non-governmental organizations. In view of its findings, the research assesses the CPTV experience in the fight against domestic violence against women in all its institutional dimensions inclusive of all its partners, and points out problems in the current implementation. In the direction of the obtained data; the cooperation process between violent institutions and the applicability of Law No. 6284 were analyzed by categorical content analysis technique
