THE EFFECTS OF LOWNESS OF THE VALUE OF THE GOODS OBTAINED THROUGH COMMITTED CRIME ON CRIMINAL RESPONSIBILITY

In the crimes committed for economic benefit, lowness of the value of goods that is the object of the committed crime has an effect to reduce the level of unjustness of offences. The legislators have granted judges the power to reduce punishment or even in some cases not punish perpetrators. The lowness of the value of goods obtained through committed crime might affect quantity of punishment for those crimes which are not clearly regulated by the legislators as well, and the effect on these offences must also be ascertained. On the other hand, even for those crimes regulated by the legislators do not constitute the same results. Hence, the abovementioned problems must be reanalyzed closely. The lowness of the value of goods means importance not only for completed offences but also attempting to commit an offence. In addition, it must be showed how to appraise lowness of the value of goods in cases of active repentance of perpetrator after committing a crime or committing multiple crimes. Lastly, the assessment of the effect of the lowness of the value of goods on sentence is necessary in terms of crimes with and without considering the special provision on the lowness of the value
