THE HIGH OPINION ABU HANIFA (R.A.) HAS HAD OF THE SUNNAH WITHIN THE CONTEXT OF ISTIHSAN AL-NASS [THE CASE OF SARAKHSY’S AL-MABSUT]

Throughout history, some allegations about Abu Hanifa (r.a.), Hanafite School’s founder to whom the majority of present day muslims belong, against his prefering rey (logical reasoning) of Sunnah have existed. The literal respond to these allegations is to prove how Abu Hanifa (r.a.) himself behaved in such situations of being faced with the contradiction of Sunnah and logical reasoning. Being a variety of istihsan which is evidence in the discipline of Islamic Jurisprudence, istihsan al-nass deals just with this subject itself. Accordingly, the approachment and understanding of Abu Hanifa (r.a.) to istihsan al-nass will at the same time prove his looking at the Sunnah.
