Termination of Obligation Due To Merger of The Titles of Debtor and Creditor In Turkish Obligation Law (TOC art. 135)

The merger of the titles of debtor and creditor from the termination of obligation is stipulated by Turkish Obligation Code art. 135. According to TOC art. 135 “The obligation shall terminate when the titles of debtor and creditor are mergered in the same person. However, the existing rights of third persons on the credits shall not be affected by the merger./ When the merger is removed retroactively, the obligation shall continue to be valid./ The specific provisions on the pledge on immovable property and negotiable security are reserved.” In our study, firstly, we give general information about the merger of the titles of debtor and creditor.
