CRIMINAL AND ADMINISTRATIVE SANCTIONS AGAINST “DUD CHEQUE” MARKS IN THE LIGHT OF NEW AMENDMENTS OF LAW NO. 5941

Cheques a reliable negotiable instrument and has a widespread use in Turkey, however, from past to today, dud cheques become a serious problem for the markets and legal practitioners. This problem should be deal with an approach regarding fair trial principle and the neccessities of commercial life. This paper focuses on criminal and administrative sanctions when a cheque is to be marked as a “dud cheque”. Considering historical development, doctrine, court decisions and scholarly works, the study aims to provide the most appropriate solution related to the concerned criminal and administrative sanctions, for legal practitioners and commercial actors
