The Assessment of Code- 6360 within the Context of Village Guard System

This paper aims to clarify the new legal status of Security (Village) Guard System and its hierarchical position in the state structure, which came after Code 6360 amendment. Scope of this research is limited to analyzing the links between Code- 6360 and Security Guard System. In the study, literature review and legislative review methods were used. Research revealed three important findings: (1). There may be some practical problems in meeting the values of scale economy, efficiency, effectiveness, democratization, participation, etc., which are mentioned on the grounds of Code 6360. (2) By promulgating Code 6360, the applicability of the Village Code 442, which constitutes the legal basis of the village guards system, has been removed and the legal basis of the village guard system has been weakened. (3) Centralization of local public services in the periphery may prevent the residents of security guard dwelling units benefit from these local services, particularly in the cities in which counter terrorism operations are intensely carried out
