KNOW-HOW CONTRACTS

ABSTRACT Know-how contracts, can be defined as a contract imposing liability to know-how producing party of giving know-how recipient party to disclose and use of know-how, and to know-how receipient party of paying a specific know-how fee to producing party in exchange for that. Today, there is a rapidly increasing technology exchange between developing and underdeveloped countries. Moreover, it can be argued that depending upon technological development, the competition between enterprises will increase, there will be some difficulties in competitiveness among enterprises and as a natural consequence, the significance of know-how contracts will increase in national and international context. In this article, types of know-how contract will be differentiated from similar contracts, its legal character will be emphasized and know-how contract will be the subject of the examination as a whole
