RIGHT TO SURVIVOR’S PENSION IN THE FEDERATION OF BOSNIA AND HERZEGOVINA

Sa？etak Upon the occurrence of social risk or the death of family’s breadwinner who was the insured person of pension beneficiary, the Federal Pension Insurance institute, as the debtor, authorizes the members of his/her family, as the trustees of the social and legal relationship, to demand she execution of social benefits. The right of family members to survivor’s pension requires the fulfillment of general conditions related to the deceased person and special conditions on behalf of his/her family. Both types of conditions bear equal importance as the failure to meet any of them creates the obstacle to exercise the right to survivor’s pension. The article examines all the conditions required for a person to exercise the right to survivor’s pension. In addition, it presents various solutions of the “old” and “new” Law on Pension and Disability Insurance of Bosnia and Herzegovina Federation and analyzes the new arrangements in accordance with the basic principles that serve as the foundation of survivor’s pension
