汉语法律典籍中“刑”的英译选词研究——以《尚书？吕刑》的英译本为例

Abstract:
《尚书》之类蕴含丰富中华法律文化典籍的对外译介与传播，是树立中国文化自信，“讲好中国故事”，向西方世界“真实、立体”彰显中国传统法律精神文化的重要途径，亦是典籍翻译者、法律语言学者及比较法学研究者责无旁贷的使命。古代法律典籍语言的翻译，要求译者既要理解汉语专业知识，又要熟练运用译入语将其表达精炼凝结。有鉴于此，本文基于当代法律翻译理论，聚焦“刑”这一传统法律专业术语的英译选词研究，探讨汉英法律翻译的基本策略，凸显法律典籍翻译的根本原则——严肃性与准确性。
Foreign translation and dissemination of Chinese classics containing abundant legal culture in ancient China such as Shangshu, is of vital importance to establish cultural confidence—“relate good stories about China”, and reveal traditional spirit of Chinese legal culture in “real and three- dimension” to the western world. It is also regarded as a duty-bound mission of the classics trans-lators, legal language scholars and comparative law researchers. The translation of Chinese legal classics requires the translator to understand the professional knowledge of ancient Chinese as well as composing concise and precise expression by using the target language proficiently. In view of this, based on contemporary legal translation theories, this article focusing on the study of word choice in English translation of “Xing”, a traditional legal term, probes into the basic strategy of legal translation between Chinese and English, to manifest the fundamental principles of the translation of legal classics—seriousness and accuracy.
