规制与引导：对媒体报道医疗纠纷的法律 思考
Regulation and guidance: a legal consideration of media reports on medical disputes

媒体报道医疗纠纷在一定程度上促进了医疗纠纷的解决，但也存在诸多问题，如报道立场不中立、 新闻内容不专业、报道过程不严谨等，必须对其加以规制和引导。而运用法律等社会控制手段对媒体报道医疗纠 纷进行规制，有利于构建和谐医患关系和指引媒体理性表达诉求。具体说来，可从以下几点着手：完善立法规定 和司法适用，加强媒体监管和引导教育，从而将媒体报道医疗纠纷纳入到良性的法制轨道。
To a certain extent, the media reports on medical disputes promote the solution of medical disputes, but there are many problems as well. The position of the report is not neutral; the news content is not professional; the process of reporting is not strict and so forth. So they must be regulated and guided. And the use of law and other social control means to regulate the media reports on medical disputes is beneficial to harmonous doctor-patient relationship and the rational expression of the media. In particular, we can start from the following points: we should improve the legislative provisions and judicial application, strengthen the media supervision and guidance education, so that the media reports on medical disputes can step on a healthy legal track
