“微时代”新闻传播的“合理使用”与传播权益：以“甘柴劣火”为例
News Communication in WeChat Public Accounts: “Fair Use”and Communication Rights and Interests in “Ganchailiehuo”

摘要 本文以“甘柴劣火”事件为例，从新闻传播的角度对著作权法“合理使用”制度在新的环境中进行了分析，思考了微时代环境下新闻传播各方权力与权益的博弈。“人人都是报道者”意味着传播权力的转移，权力与权益关系也需要平衡，著作权法中的“合理使用”制度是保护双方利益的关键。此外，本文对新闻事实引述与作品抄袭的界限进行了解析。从目前的环境看，无论《甘柴劣火》是一篇具有“洗稿”性质的稿件还是具 有独创性，这一问题实际并无太大意义，学界与业界更需要讨论的应该是，如何营造贯彻“合理使用”制度的法律环境，以实现个人权利与社会利益的平衡。
In the perspective of news communication, this paper taking the event of “Ganchai and Liehuo” as an example, analyzes the concept of “fair use” of copyright law. And it studies the game between the rights and interests of all news communication parties in the era of WeChat.The characteristic of ”Everyone is reporter “in times of Wechat indicates the transfer of communication power. It also means that the relationship between rights and interests of communication waits to be balanced. The “Fair use” of copyright law is the key to protect their rights. Moreover, this paper also interprets the boundary between news fact quotations and plagiarism. In the current environment, it is not too much signifcance to discuss whether “Ganchai and Liehuo”being washed or originality. For achieving the balance between individual rights and social interests, what the academic circle and the industry need to discuss is how to create a legal environment to implement the “Fair use”system
