中国过程防腐的微观制度要素及其协同建构

腐败治理的关键在于科学有效地监督和制约权力,因而必须聚焦于公共权力运行过程及其行使者本身。过程防腐作为制度反腐的中介环节和过程机制,是实现“惩防并举”和“标本兼治”的重要路径。政务信息公开和公职人员财产申报(公示)作为主要实现方式,在具体实践中依然存在诸多困境。根据反腐倡廉协同性原理,相关制度要素的完善性和协同性直接关涉着过程防腐实效。为此,本文围绕公职人员及其职权本身,将廉洁档案与权力清单、财产申报(公示)一起作为过程防腐的微观制度要素,通过对相关制度要素的协同建构来强化对具体权力运行环节的过程监督,形成从源头上防治腐败的协同治本机制,从整体性上推进中国腐败治理能力的现代化。

As the intermediary link of system anti？？corruption and process mechanism, process anti？？corruption is an important way to achieve the goal that both punishment and prevention can be done and that both the symptoms and its root cause can be treated. There are a great many difficulties in the regulation and prevention of power with government information disclosure and public property declaration. According to the cooperativity principle of anti？？corruption and building a clean government, the perfection and synergy of relevant system elements are directly related to the actual effect of process anticorrosion. Therefore, it is suggested that power list, property declaration and integrity archives should be micro？？institutional elements to process mechanism of anti？？corruption. Through the collaborative construction of relevant institutional elements, the process supervision of specific power operation links can be strengthened, and a collaborative mechanism to prevent and control corruption from its beginning can be formed, so as to promote the modernization of China’s corruption governance ability as a whole
