价值的司法适用及方法――以法院适用社会主义核心价值观的案例为对象
The Judicial Application of Value and Its Method ―On the case of the court’s application of core socialist values

在司法实践中,价值适用是法治的一个重要方式。通过对法院适用社会主义核心价值观的427个司法案例的考察,归纳出法院适用社会主义核心价值包括道德教育宣示型、直接证成结果型与补强证成结果型三种类型。在司法适用价值过程中,尽管大部分实践属于道德教育宣示,但仍然在规范立场、价值选择和价值推理三个方面存在规范性问题。从规范意义上而言,司法适用价值是为了弥补法律规则的局限,因此法院适用价值(社会主义核心价值观)时,应当遵守规则优先于价值、通过价值解释规则、通过规则适用价值等基本规则。
In judicial practice, the application of value is an important way of rule of law. Based on the investigation of 427 judicial cases to which the court applied core socialist values, the applications of core socialist values by the court mainly include three types, namely, moral declaration, verification, and reinforcement. However, in the process of applying value, although most of the practices are a declaration of morality, there are still normative issues in the three aspects: normative attitude, value selection and value reasoning. In the normative sense, the judicial application of value is made up for the defects of legal rules. Therefore, when courts apply values (core socialist values), they should be bound by the following basic rules: rules taking precedence over values, interpreting rules by values, and applying values by rules
