我国国际商事法庭的若干核心问题

中国国际商事法庭的构建对于公正高效解决商事争议,服务和保障“一带一路”建设意义重大。管辖权的扩大是国际商事法庭的发展趋势,中国国际商事法庭可考虑将涉港澳台商事案件以及自贸区外商独资企业之间商事纠纷纳入管辖范围,同时放开对“实际联系”的要求;“一站式”国际商事纠纷解决机制宜通过仲裁调解机构的选定实现争议解决的国际化和专业化,应重视调解的适用并确保各类文书的有效承认和执行;国际商事专家委员会作为中国创举,应充分发挥专家委员在争议解决中的作用,并关注专家委员的利益冲突问题;诉讼程序便利化改革则需权衡公正与效率、自治与法定、公开与私密等问题。
The Construction of China International Commercial Court (CICC) is of great significance to settle commercial disputes impartially and efficiently as well as assist in and safeguard the Belt and Road Initiative. Following the current trend to broaden the jurisdiction of international commercial courts, CICC may consider extending its jurisdiction to Hong Kong, Macao, Taiwan-related commercial cases and disputes between wholly foreign-owned enterprises in Free Trade Zones. Meanwhile, CICC could waive the substantial connection requirement when deciding its jurisdiction. The “one stop” international commercial disputes settlement mechanism could select proper arbitration and mediation institutions to achieve the internationalization and professionalization of disputes settlement, pay attention to the application of mediation and ensure the effective recognition and enforcement of all kinds of instruments. As the pioneering innovation of our country, the International Commercial Experts Committee should give full play to the role of experts in disputes settlement and pay attention to the conflict of interest issue concerning experts. The facilitation of legal proceeding should balance the relationship between impartiality and efficiency, autonomy and legality, publicity and privacy
