“三权分置”下的农村土地承包关系长久不变研究
A Research on Long term Stabilization of Rural Land Contracting Relation under the Background of Three RightsSeparation

基于农村土地“三权分置”的背景，运用文献分析法和归纳演绎法，构建农村土地承包关系长久不变的具体制度。“长久不变”是“三权分置”的逻辑起点，“三权分置”是对“长久不变”的重大理论发展。我国农村土地权利结构从“两权分置”到“三权分置”的变革，为更好地落实“长久不变”提供了强有力的制度保障。应当在坚持集体土地所有权的前提下，通过稳定土地承包权，构建“长久不变”的具体规则，土地经营权的有序流转应当是其重要考量因素之一。“长久不变”的具体制度设计，应当坚持承包期内和承包期届满不再调整承包地块，这将通过明确持续承包、继续承包是土地承包权的内容而实现。“长久不变”应当坚持现行的承包期限，并明确土地承包权消灭的法定情形。
Under the background of three rights separation of rural land,the specific system of long-term stabilization of rural land contracting relation should be built by means of document analysis and induction and deduction.The long-term stabilization is the foundation of the three rights separation.And the three rights separation is a significant theoretical development of the long-term stabilization.The reformation of rural land right structure in China from the two rights separation to the three rights separation provides a strong political guarantee for better implementing long-term stabilization.Sticking to the collective land ownership,the government should work out the specific rules of the long term stabilization via stabilizing the land contract right.The orderly transfer of land management right should be attached with great importance.The design of specific rules should conform to the concept that there is no adjustment to the contracted lot within the contracting period and at the expiration of contracting term,which should be realized by acknowledging the durative contract and the consecutive contract as indispensible parts of the land contract right.The long-term stabilization should maintain the existing contracting term and clarify the legal situations under which the extinction of land contract occurs.
