关于唐代婚姻立法若干问题的思考
Reflections on the Marriage Legislation in the Tang Dynasty

摘要 唐代婚姻立法不仅系统地总结了以前历代王朝的立法和司法经验，而且完整地体现了唐代统治者的立法思想和原则，充分地表现出唐律“一准于礼”的典型特征；唐代婚姻立法还具有明显的两重性，即许多法律条文中既有专制的、落后的、保守的成分，又透露出些许自由的、先进的、开放的气息；唐代婚姻立法不仅在主张与内容上具有不可调和的矛盾性，而且在技术与体制上有着明显的不平衡性。
Abstract：The marriage legislation of the Tang Dynasty not only systematically summed up the legislative and judicial experience of the previous dynasties， but also embodied the legislative thoughts and principles of the rulers of the Tang Dynasty， which fully demonstrated the typical feature “ceremony rules first” of the Tang Dynasty. There are also obvious dualities in the marriage legislation of the Tang Dynasty， i.e.， some legal provisions are authoritarian， backward and conservative， however， others have more free， advanced and open components.
