Abstract:

集体经营性建设用地入市关系到城乡一体化资源配置与利益共享格局的构建,是我国集体建设用地改革的突破点。作为未来可设计为部分取代我国土地征收制度的一种新型用益物权,采用概括法与列举排除法,构建起以用途规划及管制为核心、以经营性为衡量指标,与农村宅基地、公共公益用地相行并列的流转范围体系极其重要。现实中农村集体经营性建设用地事实混同严重,应以落实宅基地与公益用地确地、确权为保障,在遵守规划和用途管制前提下处理好政府与市场的关系,以实现有效入市与降低风险的双重目标。
The transaction of rural commercial collective-owned construction land is the breakthrough point of reform of the collective construction land, which is related to the construction of resource allocation and benefit sharing pattern during the course of urban and rural integration.As a new type of usufruct to replace partly the current land expropriation system in future, it’s important to use generalization method and enumeration method in building the collective construction land’s scope of circulation system, which takes uses planning and control as the core and is based on operational metrics, with the homestead and public land in parallel. In reality, the fact confused. The collective construction land right verification rests on implementing the homestead right verification and public land definition, and complying with the planning and use control to deal with the relation between government and market. In this way, it can effectively guarantee the transaction of rural collective-owned commercial construction land, and is also conducive to reduce risk.
