2014年10月召开的中国共产党十八届四中全会明确指出“坚定不移走中国特色社会主义法治道路”，这标志着中国特色社会主义法治道路已经形成。其本质特征主要体现在四个方面，即在社会主义初级阶段基础上的法治道路；由执政党直接领导和推进的法治道路；突出依法执政的法治道路；立足中国国情，并吸取人类其他法治有益经验的法治道路。
