强者理念与弱者理念的对弈——论劳动法双重视角的碰撞

Abstract:
劳动法以劳动关系为调整对象,在劳动者与用人单位的双方主体间,劳动法选择了倾斜保护劳动者的视角并展开制度设计。从劳动关系产生的历史我们看到了劳动法诞生的历史使命,而对现代劳动关系的解析也使弱者理念成为劳动法必然的选择。在两种理念的互动、博弈中,劳动法既要贯彻倾斜保护弱者的理念,又要对劳动者弱者理念进行必要的反思,把握倾斜保护的尺度,达致劳动关系平衡协调的调整目的。
Labor Law regulates the labor relationship and is formulated in the priority of laborers over employing units. It can be seen from the history of the labor relationship which is the historical mission of Labor Law. Besides, due to the analysis of the modern labor relationship, the ideas of protecting vulnerable groups became the inevitable choice for Labor Law. During the interaction and conflict of these two theories, the ideas of protecting vulnerable groups need to be implemented, as well as rethought. To achieve the balance of the labor relationship, the scope of protection in Labor Law must be clear.
