自然风景资源管理机构法人化研究
A Study on the Legalization of Natural Landscape Resource Management Agency

目前我国自然风景资源行政管理体制呈现出“两线多级”的特点。自然风景资源管理机构作为政府主管部门的派出机构，不具有独立的法人地位，法行使自然风景资源的所有权。为了摆脱现有困境，必须实现自然风景资源管理机构的法人化，明确自然风景资源的权利主体和责任主体，提高管理效率，以更好地实现对自然风景资源的利用和保护。基于对域外国家公园的考察，对公益性法人制度以及我国事业单位改革经验的借鉴，具体的制度构建应该以确立法人财产权为基础，以完善法人治理规则为支撑，以专门立法为保障，从而最终推动我国自然风景资源管理机构法人化的改革。
At present, the administrative system of natural landscape resources in China has the characteristics of "two lines and multi level". Natural landscape resource management agencies as the government departments in charge of the agency, do not have an independent legal status, they cannot exercise the natural landscape resources of specific ownership. In order to get rid of the existing predicament, it is necessary to realize the legalization of the natural landscape resource management institution, clear the subject of the natural landscape resources and the main body of responsibility, and improve the management efficiency so as to better realize the utilization and protection of the natural scenery resources. Based on the experience of foreign public welfare legal person system and the reform of public institutions in our country, the specific system construction should be based on the establishment of legal person property right, perfect the corporate governance rules as the support, with special legislation as the guarantee, and finally promote the reform of institutional legalization.
