非对称内外资方专利权转让的互惠交易行为演化 ――基于非实施性外资技术扩散视角

Abstract:

新经济常态下,跨业态、实力及规模差别明显的非对称内外资方会频繁开展专利权转让及商业化应用合作,而实际中双方合作却往往不能长期维系。通过设计额外交易费用、歧视性价格及专利权价值与开发周期、专利研发投资额、交互资助因子等变量,构建了内外资方专利权转让交易博弈支付矩阵,揭示出单一互惠策略均衡的实现条件,进而基于演化博弈工具,评判局中人向互惠交易行为的演化路向及稳定性,辨析影响互惠交易均衡的决策变量。此外,基于中外方就汽车“蓝驱”技术专利权交易的算例仿真,模拟决策因素以及种群初始分布对互惠交易均衡演化的影响,并提出了最优均衡实现的中外双方策略建议。
During the period of deepening reform, cooperation of patent right transfer and commercialization will happen frequently between asymmetric domestic and foreign enterprises, which are in different industries or have distinct gap in strength and size. But their collaboration is often short-lived in practice. Using evolutionary game theory,this paper analyzes evolutionary stability of patent right transfer transaction system of asymmetric domestic and foreign enterprises, and reveals influencing factors. Based on simulation, the author puts forward optimal strategy suggestions on both sides for reciprocal transaction equilibrium. It is found that reciprocal transaction behaviors were influenced by patent R&D investment, interactive assistance force, transaction cost and foreign offer. Ideal assignment of controllable factors can promote market evolution to reciprocal transaction equilibrium
