论弱势群体的司法保护
The Problems of Vulnerable Groups Protection by the Judicial

在应然层面上，司法应当对弱势群体进行保护，但从实然角度看，对弱势群体保护存在但不限于以下四个问题：法界定弱势群体的概念和范围；降低诉讼费反增诉讼成本；政府主导的法律援助效率低下；实质权衡损害司法客观性、确定性和合法性。为了解决以上四个问题，应着力减少整体的诉讼成本，引入风险代理补充法律援助，重新强调法律面前人人平等之原则。
For the vulnerable groups, many scholars believe that we should give them special protection. But there are some problems that follow: how to define the vulnerable groups? Reducing the litigation costs may rise the whole costs; the legal aid is inefficiency, and inclination to the vulnerable groups may be harmful to the judicial, especial for its objectivity, certainty and legitimacy. To solve these problems, we should reduce the whole costs, use contingency fee to help the vulnerable groups, re-emphasize the principle of equality under the law.
