“聚众斗殴致人伤亡”的理解与适用

聚众斗殴致人伤亡，按照刑法规定，依故意伤害或杀人论处。但是聚众斗殴致人伤亡既有案外辜群众的伤亡，也有案内斗殴人员的伤亡。对伤亡后果的承担既可能有直接责任人，也可能直接责任人，司法实务中应如何适用该规定惩治和打击聚众斗殴犯罪的首要分子和积极参加者是值得探讨的课题。
Affrays cause person casualties, in accordance with relevant provisions of the criminal law, are judged as intentional injury or murder.
