无人驾驶汽车致人损害的对策研究

人驾驶汽车是汽车发展的必然趋势。尽管其具有高度的安全性，但发生损害事故也是必然的。由于人驾驶汽车具有运行的自主性、驾驶模式的多样性等特征，在现行法律制度下，当其导致重大财产损失和人员伤亡时，相关主体的行为与交通肇事罪之间存在诸多龃龉，使其不具备课以交通肇事罪的相关要件，这意味着对此类事故法适用该刑罚。并且导致事故的原因多种多样，其认定也存在较大的困难。对于这一疑难问题，我们应当采取科学技术与各类制度相结合的方式予以应对，理性地解决该疑难问题，为中国人驾驶汽车的发展和运用奠定基础。
Self-driving car is the developmental trend of vehicle.Although it has a high level of security,accident and damage are inevitable.Since self-driving car has the characteristic of autonomy and diversity of driving modes,under the current legal system,when it causes significant property damage and casualties,there are many conflicts between behavior of relating subjects and the traffic accident crime,and the subjects cannot be punished for traffic accident crime for lack of related elements,which make the current law cannot regulate such incidents.On the other hand,traffic accidents could be caused by many reasons,and it is difficult to identify the one cause it.To solve this difficult problem,a rational way combining science and technology and various systems should be taken to lay the foundation for development and use of self-driving cars in China.
