互联网治理四项原则基于国际法理应成全球准则——“领网权”是国家主权在网络空间的继承与延伸
Four principles on Internet governance reflecting a global norm based on international law

习近平主席在第二届世界互联网大会上提出的“互联网治理四项原则”，包括：尊重网络主权，维护和平安全，促进开放合作，构建良好秩序。“互联网治理四项原则”根植于《联合国宪章》和国际法基本准则，亦是“和平共处五项原则”在国际网络空间的适用与发展，必将成为世界范围内规范国际网络空间关系的重要原则。“互联网治理四项原则”中尊重网络主权原则是核心与基础，维护和平安全原则是主旨与目标，促进开放合作原则是路径与策略，构建良好秩序原则是前提和保障。“互联网治理四项原则”集中反映了互联网时代各国共同构建网络空间命运共同体的价值取向，也反映了互联网时代“安全与发展”为一体双翼的主潮流。文中根据习近平主席提出的“互联网治理四项原则”，并基于国家领土主权提出的“领网权”，有着充分的现代国际法基础与依据，它将国家主权范围扩展为四维空间，是国家主权在网络空间的继承和延伸。
The four principles on Internet governance proposed by President Xi Jinping at The Second World Internet Conference,include respecting cyber sovereignty,maintaining peace and security in cyberspace,and promoting open cooperation and building good order.The four principles are rooted in the Charter of the United Nations and basic norms of international law and are in line with the application and the development in international cyberspace based on the “Five Principles of Peaceful Coexistence”.The four principles will surely be an important world-wide principle for standardizing international cyberspace relations,among which respecting cyber sovereignty is the core and foundation,maintaining peace and security is the purpose and objective,promoting open cooperation is the route and the strategy,and building good order is the premise and guarantee.The four principles focus on the values of different country joining hands to build a cyberspace destined community concentrated on “security and development” foe reflecting the two major focuses of cyberspace policy trends.The establishment of “territorial cyberspace rights” based on the four principles and the National territorial sovereignty is based on the contemporary,expanding the scope of national territory into four-dimensional space.thus it is an inheritance and extension of cyberspace in national territory
