Evolution of Death Compensation Order on the Perspective of “State-Society”

本文以“国家—社会”为分析框架系统梳理了死亡赔偿制度的发展历程，其原始复仇、自由赔偿和强制赔偿三阶段也是国家从无到有、由弱变强的演变过程。这一过程大致可划分为“强社会—弱国家或无国家”、“国家与社会制衡”以及“强国家—弱社会”三种关系形态。国家在与社会的互动博弈中逐步占据了主动，在死亡赔偿制度上的表现就是以国家为主导的赔偿秩序的形成。不过作为一个连续统，国家的力量虽然在不断增强，但也无时无刻不受到社会力量的影响。
：The paper examines the evolution of death compensation system on the perspective of “state-society”. There are three stages in the establishment of death compensation system revenge, voluntary compensation and compulsory compensation. Those three stages are in accordance with three phases in the development of the state: strong society-weak state or no state, the balance between state and society, strong state-weak society. Gradually, the state gains the upper hand in the “state-society” relationship. As a result, the death compensation system is guided by the state. As a continuum, in spite of its increasing power, the state is subject to the influence from society
