Optimization of Concept of Sports Rights Under 2030 Agenda for Sustainable Development

摘要：联合国2030可持续发展议程为重构体育与人权的关系打开了一扇新的窗户，2030可持续发展议程把健康作为基于体育的可持续发展的首要价值。基于此，从义务视角转向选取“人权”视角，以理念优化为突破口，结合党的十九报告精神，从健康权、平等权和文化权三大方面重点研究2030可持续发展议程视野下体育的权利理念优化与价值实现方式，探讨可持续发展背景下体育权利价值实现的新思路。通过理顺体育价值的公共性与私人性、体育规范的底线性与倡导性之间的关系，强化体育健康权的可持续能力；从身份认同、平等话语和社会公平3个层面保障体育性别平等权；从能力建设、门槛低化、机会均等出发构建公法、私法与社会法三向互动共治的立体型法治模式以保障残疾人体育平等权。体育文化权具有相对独立的权能和义务内涵，蕴含着包容、公正、多样性和可持续性的法理念，以体育文化的物态化、公共化和产业化来最大限度地释放体育文化权价值效能。
Abstract：The "2030 Agenda for Sustainable Development" adopted by UN opens a new window to restructure the relationship of sports and human rights; it takes health as the primary value of sports. Based on this, combined with the spirit of the 19th National Congress of CPC, this study transferred the perspective from responsibility to right, took concept optimization as a breakthrough, analyzed the concept optimization and value realization way of sports rights under 2030 Agenda for Sustainable Development in three aspects of the right to health, equality rights and cultural rights, and explored the new way to realize the value of sports rights. We can enhance the sustainability of sports rights to health through straightening out the relationship between the publicity and private nature of sports value, the bottom line and advocacy of sports norms; implement the right to gender equality in sports from three levels of identity anxiety, equal discourse and social equality; and set up stereoscopic law model of three interactive co governance of public law, private law and social law based on capacity building, low threshold and equal opportunity. The right of sports culture has relatively independent connotation of power and obligation, and contains the concept of inclusiveness, justice, diversity and sustainability, and it maximizes the release of the value of sports cultural rights by the materialization, publicity and industrialization of sports culture
