Legalization of China Sports Governance

摘要：体育治理是国家治理的重要组成部分，实现体育治理现代化是新时期体育全面深化改革的重要目标，法治化既是实现体育治理现代化的重要路径，也是体育治理现代化的重要目标之一。研究体育治理法治化，是推进全面依法治国的现实需要。运用文献资料法，探讨了中国体育治理法治化的必要性，对体育治理法治化的实现路径、评价机制进行分析。结果表明：作为一种行业治理，体育治理法治化既要遵守法治的一般规律，也要遵循体育的特殊性。体育治理法治化的实现路径包括体育治理思维法治化、体育治理主体职能的法治化、体育治理规则法治化和体育治理方式法治化。对体育治理法治化的效果认定需要建立一套科学的评估体系。
Abstract: Sports governance is a significant component of national governance, and realizing its modernization is a main target of deepening sports reform in new era. Legalization is an important way to realize the modernization of sports governance, and also is one of the aims of sports governance modernization. Studying sports governance legalization will meet actual need to promote governing the country by law. This paper discussed the necessity of the rule of law in China sports governance and analyzed its route and evaluation mechanism by the method of literature review. Results: Legalization of sports governance, as a type of industry governance, should comply with the general rule of law as well as the specificity of sports. Legalization of sports governance should include legalization of its thought, principle function, rules, and pattern. And a scientific evaluation system is required to check the effectiveness of sports governance legalization
