体育法的定位选择
Sports Law’s Positioning

摘要：体育法的合理定位有利于其在体育活动实践中释放出更大的工作效能，对解决各类冲突和争端起到良好的助力作用。本研究采用文献资料法、专家访谈法等研究方法，对体育法的定位选择进行了相关的研究。认为：1、现有体育法的定位主张过于遵循制法样式的传统习惯，低估了社会前行时对于法的现实性、综合性需求。2、焦距于某种视野的法律定位较容易导致简单依规、失却周全和过于牵强的局面。3、体育社会综合法的定位改变了基本法、促进法、社会法定位时的静止性视觉看点，将所有可能发生在体育领域中的争端理解为是带有普遍性质一定社会条件下的对抗性行为，它把以往的行业规范与司法管辖时的简单适用区分开来，创造了促成行业评判与司法管制时新的视觉触点。通过对使命担当期待下几种定位模式的研究，将体育法本应具有的规制功能加以引伸，以敦促人们对于体育法重新定位的思考。
Abstract: Reasonable positioning of sports law will benefit to giving full play to its efficiency in sports activities and solving various conflicts and disputes. This paper analyzed sports law’s positioning by the methods of literature review and expert interview. Conclusions: 1) Present sports law positioning adheres excessively to traditional habits of law making and underrated realistic and comprehensive needs of society advance to law. 2) Law’s positioning focused on a kind of perspective is easy to cause simple, farfetched and not thorough problems. 3) Positioning of sports and social integrated law has changed static perspective in positioning of basic law, promotion law and social law. All probable sports disputes are considered as common confrontational behavior under certain social conditions. It has separated previous industry standard and simple application in judicial jurisdiction and created a new perspective in industry evaluation and judicial control. This paper looked into several positioning modes of sports law and extended regulatory functions of sports law in order to urge people to consider sports law re-positioning
