PPP协议中公共工程合作方经营权与公民公共服务选择权的冲突及其协调研究――基于PPP协议排他性条款的分析
On conflict and coordination between public project contractors’ management rights and citizens’ options of public services: Analysis of exclusive provisions in PPP protocol

摘 要： 随着PPP模式的广泛适用，PPP协议中排他性条款所保障的公共工程合作方的经营权与公民公共服务选择权的冲突也日益凸显。尽管排他性条款自有其存在的合理性，但公民的选择权也同样意义重大。冲突协调的关键在于：充分保障公民的事前选择权即公民参与权，并保留事后的相对性选择权。同时，在优先权约定、利益补偿及诉权等方面保障公共工程合作方的合法权益，实现二者利益的平衡。
Abstract: With the wide application of PPP pattern, the conflict sharpens between public project contractors’ management rights guaranteed by the exclusive provisions of PPP protocol and citizens’ options of public services. The existence of exclusive provision has its own origin and its rationality, but citizens’ options of public services also have great significance. The key to balancing the conflict lies in that citizens’ pre-option rights should be protected while retaining the later relative options. Meanwhile, public project contractors’ legal rights can be protected by priority of follow-up projects, compensation of project cost and deficit, interests of the compensation and litigation rights and so on
