银行业反垄断规制权的配置与实现

摘 要： 规制权的配置与行使构成银行业反垄断规制开展的核心问题。以反垄断法为主的规制权实施既是对国际金融反垄断经验的有效借鉴，又反映出我国银行业市场化发展的利益诉求。从垄断行为规制出发，依靠制度建设有效协调权力内部关系，促成权利与权力的互动是银行业反垄断规制权的行使原则。在竞争评估、竞争执法和司法实施的制度导向下寻求银行业反垄断规制基础、实体和程序等多维度完善是反垄断规制权实现的有效依托。
Abstract: The disposition and exercise of regulatory power constitute the core issue of the development of antitrust regulation in banking industry. The implementation of the regulatory power which is mainly based on the antitrust law is not only an effective reference to the experience of international financial antitrust, but also reflects the interests of the development of Chinese banking market. It is the exercising principle of antitrust regulation right of banking to start from the regulation of monopolistic behavior, to rely on the system construction to coordinate effectively the internal relations of power, and to promote the interaction between the rights and the power. And seeking the perfection of banking system under the guidance of competition evaluation, competition law enforcement and judicial implementation is an effective support for the realization of the banking regulatory authority
