经济法语境下黑名单制度滥用的法律规制――基于案例的整理与研究
Legal regulation on abuse of the blacklist system in the context of economic law: Based on sorting out and studying cases

摘 要： 政府对经营者、经营者对消费者实施的黑名单制度，存在违法与滥用的问题，侵害了市场主体的合法权益，也影响了黑名单制度的比较优势。抑制黑名单制度的不当使用与滥用，让黑名单制度的创设和实施在法治的轨道上运行，亟需立法与司法规制。
Abstract: When the business dealer is blacklisted by the government, and the consumer is blacklisted by the business dealer, both of them break the law and abuse the system. Because of illegality and abuse of the blacklist system, the market subjects’ lawful rights and interests are violated, and comparative advantage of the system is affected. To restrain improper use and abuse of the blacklist system, and to let the establishment and implementation of the system run in the right track under the rule of law, the system should be regulated by legislation and justice
