我国反垄断相关市场界定执法实践检讨与反思――兼论《关于相关市场界定的指南》的不足与完善
Rethinking on the practice of relevant market definition in Chinese anti-monopoly

摘 要： 中国反垄断相关市场界定工作达到了较高水平，但目前还存在应当界定相关市场的案件没有界定相关市场、先确定案件结果再界定相关市场、相关市场界定透明度不高等缺陷。为了克服这些缺陷，反垄断执法机构应进一步完善《关于相关市场界定的指南》的内容，明确其法律性质与效力、厘清市场界定在反垄断执法中的地位与作用、限制供给替代方法在相关市场界定中的使用、统一《关于相关市场界定的指南》的叙事角度等，以增加相关市场界定的透明度。
Abstract: Chinese anti-monopoly market has made great achievement since the Anti-monopoly Act came into force in 2008, but it still has some shortcomings. For example, in some cases which need to define relevant market, the agencies could not define relevant market; defining the relevant market in some cases is obviously result-oriented, the process of defining the relevant market is less transparent, and the final outcome of relevant market definition is unconvincing. To correct these shortcomings, we should add and supplement contents to the Guideline on the Relevant Market Definition issued by Anti-monopoly Committee of State Council, and make relevant market definition more transparent
