教义学立场下刑法目的解释的效力与规则――兼对“追逐竞驶型”危险驾驶罪认定的反思

摘 要： 从解释的独断性特征来看，刑法教义学主要就是刑法解释学。体现在整个解释方法体系，刑法目的解释因其特有的规范维护和法益保护效力而具有重要的理论地位和实践价值。此过程中，法律文本的主、客观目的及刑事政策共同作为解释的依据，并通过一种实质解释，扩展着传统文义解释在法益保护上的局限。在此效力扩展同时，为约束可能出现的法官恣意和实质目的泛滥，该目的解释还必须受到教义学意义上适用规则的制约。该规则体系主要包括文义优先规则和融贯解释规则及其要求。
Abstract: Judging from the arbitrary characteristic of interpretation, the root of criminal law dogmatic is criminal law hermeneutics. Reflected in the interpretation system, teleological interpretation in criminal law has important theoretical and practical value because of its special validity of protecting norms and legal interests. In this process, both the subjective and objective purposes of legal text and the criminal policy can function as the basis of explanation, and extend the limitation of the traditional semantic interpretation in legal interests protection through substantial interpretation. In this extension, in order to restrain the possible judge’s arbitrariness and substantial purpose flooding, the teleological interpretation must be binding by applicable rules on the meaning of dogmatic. That is an teleological interpretation system of rules mainly made by semantic interpretation priority rules and interpretation coherence rules
