论立法语言审查程序的设置理据与技术――基于韩国立法的经验借鉴
On the theories and techniques of legislative language checking procedure: based on the experience of South Korean legislation

摘 要： 立法语言审查程序乃是一项对立法语词、句式、篇章结构等文本表达进行审查的立法程序。管窥韩国“语言审查程序”的立法实践可知，该程序在纠正语言错误、提高立法质量、实现法律的规范性和确定性上已经凸显出十分积极的效果。反观我国的立法语言运用现状，立法语言失范现象层出不穷且日益严重。因此，伴随“科学立法”“民主立法”的提出以及《立法法》修改之契机，我国立法机关应当在借鉴韩国“语言审查程序”的基础上，设立立法语言审查主体，明确语言审查的内容，并建构一套完整的立法语言审查程序，以保证立法的质量。
Abstract: Legislative language checking procedure is to check the literal expressions, such as words, sentences and chapter structures in legislation. A look into the legislative experience on language checking procedure in South Korea shows positive effect on correcting language faults, improving the qualities of legislation and realizing the normalization and accuracy of law. However, in Chinese legislative language utilization, irregularities are increasingly serious. Therefore, with the opportunities of the proposition of “scientific legislation”, “democratic legislation” and the modification of Legislative Law, our state legislature should take measures as follows on drawing the experience from South Korea: set a legislative language checking subject, clarify the contents of language checking, and construct a set of integrated legislative language checking procedure. These measures can ensure the quality and normality of legislation
