Abstract:

新民事诉讼法虽将诚实信用原则写入总则中，但因在法律规制上缺乏具体操作性规定，滥用诉讼权利现 象仍屡禁不止，导致延滞诉讼进程情况愈演愈烈，为此，本文以广东省某基层法院的司法实践为样本，通过对 该院 2013 年滥用民事诉讼权利现象的实证分析，以强化当事人的诉讼促进义务为着眼点，提出完善立法、能动 司法、诚信建设等应对措施，着力破解延滞诉讼难题。
