排污权市场的制度缺陷与完善——以交易成本为分析框架

Abstract:
排污权市场的失灵，源于不合理的法律制度导致了过高的交易成本。具体而言，排污权交易成本过高的制度原因表现为三大方面：法定交易主体范围狭小等原因导致搜寻成本过高，法律设置了部分妨碍自由议价的行政许可事项及直接干预排污权二级市场的定价导致议价成本过高，法律对非正式排污权转让合同的法律定性不明导致了合同监督成本攀升。对此，法律的改良之道在于放宽排污权交易主体的限制、放松排污权价格管制、简化并逐步取消排污权交易事前审核程序和明确非正式排污权转让合同的效力。
